Abstract

Gender discrimination in generative artificial intelligence systems is frequently treated as a correctable technical problem, but this framing leaves intact the epistemological presuppositions that underlie it. Drawing on Judith Butler's theory of performativity and the technical workings of large language models, the article argues that these systems do not represent gender identities but produce them, through the reiteration of patterns extracted from corpora constituted on the basis of a gender ontology whose premises have not been interrogated. The contribution is epistemological in nature and centers on the concept of algorithmic gender performativity, developed from queer studies and intersectional perspectives as analytical tools for interrogating the categories these systems presuppose when classifying. The proposed shift has implications for algorithmic governance, anti-discrimination law, and data protection.
